Template Terms & Conditions

1. Introduction

These Terms and Conditions ("Terms") govern the purchase and use of digital Squarespace templates ("Templates") provided by Square Flair Design, operated by Liliana Trinca, ABN [Insert ABN] ("we," "us," "our," or "SquareFlair Design").

By purchasing, downloading, or using our Templates, you ("Customer," "you," or "your") agree to be bound by these Terms. If you do not agree to these Terms, do not purchase or use our Templates.

2. Template License & Usage Rights

2.1 License Grant

Upon full payment, we grant you a non-exclusive, non-transferable license to use the purchased Template for your own website or your client's website (if you are a web designer or agency).

2.2 Permitted Uses

You may:

  • Use the Template for one (1) website project

  • Customise colours, fonts, images, and content to suit your needs

  • Modify the Template's design elements for your specific use

  • Use the Template for personal or commercial purposes for your own business

2.3 Prohibited Uses

You may NOT:

  • Resell, redistribute, or share the Template with others

  • Use the Template for multiple websites without purchasing additional licenses

  • Claim ownership of the Template design

  • Remove copyright notices or credits from the Template files

  • Create derivative templates for commercial distribution

  • Share login credentials with unauthorized persons

  • Use the Template in any way that violates Australian Consumer Law, GDPR, or applicable US laws

2.4 Additional License Purchases

Each website requires a separate license ($468 AUD per template). Contact us for volume licensing options if you need multiple licenses.

3. Delivery & Installation

3.1 Delivery Timeline

Templates are delivered via your personal project portal within 24 business hours of payment confirmation. You will receive setup instructions via email.

3.2 Requirements

  • You must have or create a Squarespace account

  • Templates are compatible with Squarespace 7.1 (Fluid Engine)

  • You are responsible for any Squarespace subscription fees

3.3 Installation Support

Basic setup instructions are provided. Additional customisation support is available for an additional fee.

4. Payment & Pricing

4.1 Pricing

All prices are displayed in Australian Dollars (AUD) and include applicable taxes.

4.2 Payment Methods

We accept major credit cards and PayPal. Payment is processed securely through Stripe.

4.3 Payment Terms

Payment is due in full at the time of purchase. Templates are not delivered until payment is confirmed.

5. Refunds & Returns

5.1 Consumer Guarantees (Australian Consumer Law)

We comply with the Australian Consumer Law (ACL). Our Templates come with guarantees that cannot be excluded under the ACL. If a Template has a major problem that constitutes a failure of a consumer guarantee, you are entitled to a refund or replacement.

5.2 Digital Product Policy

Due to the nature of digital products that are immediately accessible upon delivery, all template sales are final. Once your template is delivered to your project portal, the sale is complete.

5.3 Refund Eligibility (Limited Circumstances)

Refunds will only be considered in the following limited circumstances:

  • The Template has a significant technical defect that prevents basic functionality and cannot be resolved through our support

  • The Template is substantially different from what was clearly advertised on our website

  • Technical issues on our end prevent proper delivery that cannot be resolved within 7 business days

5.4 Refund Exclusions

Refunds will NOT be provided for:

  • Change of mind or business direction

  • Incompatibility with third-party plugins not specified in our requirements

  • Customisation difficulties or learning curve with Squarespace

  • Dissatisfaction with design aesthetic after purchase

  • If Template has been accessed, downloaded, or significantly modified

  • Inability to complete customisation due to lack of technical skills

5.5 Refund Process

To request a refund under the limited circumstances above, contact us at liliana@squareflairdesign.com within 7 days of purchase with your order number and detailed explanation. All refund requests are subject to review and approval at our discretion. Approved refunds will be processed within 5-10 business days minus payment processing fees.

5.6 Support Instead of Refunds

Rather than seeking refunds, we encourage customers to utilise our comprehensive support resources, setup guides, and direct assistance to achieve success with their template.

6. Intellectual Property

6.1 Copyright Ownership

All Templates are original works created by Square Flair Design and are protected by copyright laws. We retain all intellectual property rights in the Template designs.

6.2 Third-Party Content

Some Templates may include fonts, images, or other elements licensed from third parties. You are responsible for obtaining appropriate licenses for any third-party content you choose to use.

6.3 DMCA Compliance (US)

We respect copyright laws and will respond to valid DMCA takedown notices. If you believe your copyright has been infringed, contact us with the required DMCA information.

7. Warranties & Disclaimers

7.1 Limited Warranty

We warrant that Templates will substantially conform to their descriptions and will function as intended when properly installed on Squarespace.

7.2 Disclaimer of Warranties

EXCEPT AS REQUIRED BY LAW, TEMPLATES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

7.3 Platform Dependencies

Templates are designed for Squarespace 7.1. We are not responsible for changes to the Squarespace platform that may affect Template functionality.

8. Limitation of Liability

To the maximum extent permitted by law:

  • Our total liability for any claim arising from these Terms or Template use shall not exceed the amount paid for the Template

  • We shall not be liable for indirect, incidental, special, consequential, or punitive damages

  • We are not responsible for lost profits, data loss, or business interruption

Note: This limitation does not apply to consumer guarantees under Australian Consumer Law or other mandatory consumer protections.

9. Privacy & Data Protection

9.1 Data Collection

9.2 GDPR Compliance (EU Customers)

If you are located in the European Union, we process your data in accordance with GDPR requirements. You have rights to access, rectify, erase, and port your personal data.

10. Updates & Modifications

10.1 Template Updates

We may occasionally update Templates to fix bugs or improve compatibility. Customers who have purchased a Template are entitled to these updates at no additional cost for 12 months from purchase.

10.2 Terms Changes

We may update these Terms from time to time. Material changes will be notified via email. Continued use of our Templates after changes constitutes acceptance of the updated Terms.

11. Termination

11.1 License Termination

Your license to use a Template may be terminated if you breach these Terms. Upon termination, you must cease using the Template and remove it from any websites.

11.2 Effect of Termination

Termination does not affect any websites already launched using the Template, but you may not use the Template for new projects.

12. Governing Law & Disputes

12.1 Governing Law

These Terms are governed by the laws of New South Wales, Australia, without regard to conflict of law principles.

12.2 Jurisdiction

Any disputes arising from these Terms or Template use shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.

12.3 Dispute Resolution

Before initiating legal proceedings, parties agree to attempt resolution through good faith negotiation. If unsuccessful, disputes may be resolved through mediation or arbitration.

13. General Provisions

13.1 Entire Agreement

These Terms constitute the entire agreement between you and SquareFlair Design regarding Template purchases and use.

13.2 Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.

13.3 Assignment

You may not assign your rights or obligations under these Terms without our written consent. We may assign our rights and obligations without restriction.

13.4 Force Majeure

We are not liable for delays or failures in performance due to circumstances beyond our reasonable control.
